Tradeiators Client Agreement - Terms and Conditions

This Client Agreement (the "Agreement") governs your use of the Tradeiators website and services. Tradeiators (the "Platform") is operated by SAL Innovations, a company based in Malta (referred to as the "Company," "we," "us," or "our"). By registering for an account or participating in any trading challenge on Tradeiators, you (the "User," "Client," or "you") acknowledge that you have read, understood, and agree to be bound by this Agreement.

Services Provided

Tradeiators provides an online platform for competitive trading challenges between registered users. Our services merge real-time financial market data with a gamified trading experience, allowing users to compete based on their trading performance using Contracts for Difference ("CFDs") on various underlying assets.

  • Competitive Trading Challenges:

    The Platform enables users to join or create live trading competitions against other users. Challenges may be one-on-one battles or tournaments involving multiple participants. Each challenge has a defined format and a criterion for determining the winner.

  • Real-Time Market Data and Simulation:

    Tradeiators provides real-time market quotes, price charts, and trading tools to simulate an authentic trading environment. No actual trades are executed in the real market on your behalf during these challenges; all trading activity is virtual and solely for competition purposes.

  • Educational and Entertainment Purpose:

    The Platform is intended to be a skill-based competition and educational tool. We do not provide investment advice or financial advisory services. Participation in Tradeiators challenges is for entertainment and competitive purposes.

  • Leaderboards and Community Features:

    Tradeiators may offer leaderboards, rankings, badges, chat rooms, forums, or social features as part of the services. All such features are governed by this Agreement.

Eligibility

By creating an account or using the Platform, you represent and warrant that you meet all of the following eligibility criteria:

  • Minimum Age:

    You are at least 18 years of age, or older where local law requires a higher minimum age. The services are not intended for minors.

  • Legal Capacity:

    You have the full legal capacity and authority to enter into this Agreement.

  • Jurisdictional Restrictions:

    You are accessing the Platform from a country where participation in the services is legal and permitted. If you are located in a country where our services are prohibited or restricted by law, you must not use the Platform.

  • No Previous Bans:

    You have not been previously suspended or removed from the Tradeiators Platform.

  • Compliance with Rules:

    You are willing and able to comply with this Agreement and all applicable Platform rules.

Account Registration and User Responsibilities

  • Account Creation:

    You must create a user account to participate in Tradeiators challenges. You agree to provide truthful, current, and complete information. Each user is generally allowed to register only one account.

  • Account Security:

    You are responsible for maintaining the confidentiality and security of your account login credentials. If you suspect unauthorized use of your account, you must immediately notify us.

  • User Conduct and Acceptable Use:

    You agree to use our services only for lawful purposes. You must not misrepresent your identity, share accounts, engage in harmful behavior, harass other users, upload malicious code, or attempt to reverse-engineer the Platform.

  • Account Verification:

    We may require you to complete an account verification process to comply with AML and KYC obligations.

Deposits and Withdrawals

Users may deposit funds into their Tradeiators account and withdraw available funds through the payment methods provided in the Platform's cashier interface.

  • Authorized Payment Methods:

    You must use your own funds and payment instruments when making deposits. We do not accept third-party payments.

  • Payment Processing and Timing:

    Deposits are generally credited as soon as we receive confirmation from the payment processor. Withdrawal processing times can vary depending on the payment method.

  • Fees and Currency Conversion:

    Tradeiators may charge certain fees for deposits or withdrawals. The Company is not liable for any fees or charges imposed by your bank or payment provider.

  • Anti-Money Laundering Compliance:

    We may require additional verification before processing a withdrawal, especially for large amounts.

  • Reversals and Chargebacks:

    If any deposited funds are subject to a chargeback, you agree that we have the right to deduct the amount from your account balance.

  • No Interest on Balances:

    Any funds held in your Tradeiators account do not earn interest. The Platform is not a bank or financial institution.

Fees

The use of Tradeiators may be subject to various fees. We strive to make all fees transparent. Any fees charged by the Company will be disclosed to you prior to incurring them.

  • Participation or Entry Fees:

    Some trading challenges may require an entry fee. All entry fees will be clearly stated on the competition listing before you join.

  • Service Fees or Commission:

    The Platform may charge a service fee on competitions or on winnings. If such a fee applies, it will be made transparent.

  • Deposit and Withdrawal Fees:

    The Company does not charge a direct fee for deposits in most cases. Withdrawals may be subject to fees depending on the method. Some methods might carry third-party fees.

  • Taxes:

    Fees do not include any taxes that may apply. It is your responsibility to report and pay any taxes due to your own tax authorities.

User Competitions and Challenges

When using Tradeiators, the core activity is participating in user-vs-user trading competitions. This section outlines the rules governing competitions on the Platform:

  • Joining and Starting a Competition:

    To join a competition, you must follow the instructions on the Platform. If there is an entry fee, it will be deducted from your account balance at that time.

  • Competition Rules:

    Each competition will have specific rules including permitted trading instruments, duration, limits, and conditions for victory. It is your responsibility to read and understand the rules before joining.

  • No Collusion or Teaming:

    Users shall not team up to gain an unfair advantage. Each user is expected to make independent trading decisions.

  • No Automated Trading (unless allowed):

    Unless explicitly allowed, you are expected to place trades manually. The use of unauthorized trading bots is prohibited.

  • Determination of Winners:

    At the end of a competition, the Platform will calculate each participant's performance. Competition results as determined by the Platform are considered final.

Dispute Resolution

We strive to maintain a fair and transparent platform. If you have a complaint or dispute regarding the Platform, you should first contact us directly to seek resolution.

  • Online Form or Email:

  • Acknowledgment and Timeframe:

    We will acknowledge receipt of your complaint within 1-2 business days. We aim to resolve and respond to disputes within 10 business days.

  • Resolution and Decision:

    Our team will provide you with a decision or resolution in writing. The Company's decision on the dispute will be final from the perspective of the Platform's internal resolution process.

Termination and Suspension of Accounts

Both the user and the Company have the right to terminate this Agreement and the use of the Platform.

  • User-Initiated Termination:

    You have the right to terminate your account at any time by contacting us at [email protected].

  • Company-Initiated Termination:

    The Company reserves the right to suspend or terminate your account for breach of Agreement, prohibited conduct, extended inactivity, regulatory requirements, or security issues.

  • Effect of Termination:

    Once terminated, your right to use the Platform ceases. Provisions that should survive termination (such as Limitation of Liability, Governing Law) will survive.

  • Multiple Accounts and Ban Evasion:

    If your account is terminated, you are not allowed to create another account to bypass the ban.

Limitation of Liability and Disclaimers

Use at Your Own Risk: Use of the Tradeiators Platform and participation in trading challenges is at your own risk.

  • No Guarantee of Earnings:

    The Platform makes no guarantee that you will win any challenge or earn any particular amount of money.

  • Platform Provided "As Is":

    Tradeiators and all of its services are provided on an "as is" and "as available" basis, without warranties of any kind.

  • Limitation of Liability:

    To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages including any loss of profits, loss of data, loss of opportunity, trading losses, or business interruption.

  • Force Majeure:

    The Company shall not be liable for any failure or delay caused by circumstances beyond our reasonable control.

  • Indemnification:

    You agree to indemnify and hold harmless SAL Innovations from any claims arising out of your misuse of the Platform, your violation of this Agreement, or your violation of any laws or rights of third parties.

Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of Malta. By using the Platform, you and the Company both consent that the laws of Malta will exclusively govern the relationship between you and us.

If a dispute proceeds to court, the courts of Malta shall have exclusive jurisdiction to hear and settle that dispute, unless another jurisdiction is mandatorily required by applicable law.
